These Terms and Conditions ("Terms") govern your access to and use of the Culture Cannabis Club website, mobile application, and related services (collectively, the "Service") operated by Culture Cannabis Club ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Service.

1. Acceptance of Terms

By accessing, browsing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms as well as any additional terms and policies referenced herein. If you disagree with any part of these Terms, you must immediately stop using the Service.

2. Eligibility and Age Requirements

Culture Cannabis Club is intended for individuals who are legally allowed to purchase, consume, or otherwise interact with cannabis in accordance with applicable law. Generally, you must be at least 21 years old to access and use the Service. Notwithstanding the foregoing, if you are between 18 and 21 years old, you may access the Service for cannabis consumption only if you provide a valid medicinal cannabis recommendation from a licensed physician, in compliance with all applicable laws and verification procedures.

Verification Process: Users in the 18–21 age range must undergo a verification process, which may include the submission and review of government-issued identification and valid medicinal documentation.

Responsibility: If you are under 21 without a valid medicinal recommendation, you are not permitted to access cannabis-related products or services on our platform.

3. User Accounts and Security

3.1 Account Registration

Accuracy of Information: When creating an account, you agree to provide accurate, complete, and current information.

Responsibility: You are solely responsible for safeguarding your account credentials and for all activities that occur under your account.

Account Recovery: In the event you forget your password or suspect any unauthorized access, you agree to follow our account recovery procedures promptly and notify us immediately.

3.2 Breach and Unauthorized Use

You must notify us immediately if you become aware of any breach of security or unauthorized use of your account. Failure to do so may result in your account being suspended or terminated.

4. Intellectual Property Rights

Ownership: All content, features, and functionalities of the Service—including but not limited to text, graphics, logos, images, software, and other materials—are the exclusive property of Culture Cannabis Club or its licensors.

Limited License: You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.

Restrictions: You may not reproduce, modify, distribute, or create derivative works based on our content without our explicit written permission.

5. User-Generated Content

If the Service allows you to submit, upload, post, or otherwise share content ("User Content"), you retain your rights in that content. However, by submitting User Content, you grant Culture Cannabis Club a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform such content solely for the purposes of operating and promoting the Service. You represent and warrant that you have all necessary rights to grant this license.

6. Third-Party Links and Services

Our Service may contain links to third-party websites or services (e.g., www.treez.io, www.shopify.com) that are not owned or controlled by Culture Cannabis Club. We do not endorse or assume any responsibility for the content, privacy policies, or practices of any third-party sites or services. You acknowledge and agree that Culture Cannabis Club shall not be liable for any damage or loss caused by or in connection with your use of any third-party content, goods, or services.

7. Payment, Refunds, and Purchases

If you engage in transactions through the Service for the purchase of products or services:

Payments: You agree to provide accurate payment information. All transactions are subject to verification and processing by our payment partners.

Refunds and Cancellations: Any payment, refund, or cancellation policies applicable to purchases will be outlined at the point of sale and form part of these Terms.

Pricing Errors: In the event of a pricing error or any mistake in processing, we reserve the right to cancel any orders or transactions at our discretion.

8. Termination of Use

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

Any other conduct that may harm the interests of Culture Cannabis Club or its users.

Upon termination, your right to use the Service ceases immediately. Any data associated with your account may be retained or deleted in accordance with our data retention policy. You may also terminate your account at any time by discontinuing use of the Service, subject to any outstanding obligations.

9. Disclaimers and Limitations

9.1 Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted service.

9.2 Limitation of Liability

To the maximum extent permitted by applicable law, Culture Cannabis Club shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (i) your access to or use of, or inability to access or use, the Service; (ii) any conduct or content of any third party on the Service; or (iii) any unauthorized access, use, or alteration of your transmissions or content.

10. Indemnification

You agree to indemnify, defend, and hold harmless Culture Cannabis Club, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California and the United States, without regard to its conflict of law principles.

11.2 Dispute Resolution

Negotiation: In the event of any dispute, claim, question, or disagreement arising from or relating to these Terms or the Service, you agree to first attempt to resolve the dispute informally through good-faith negotiations.

Arbitration: If the dispute cannot be resolved informally within 30 days, it shall be finally resolved by binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will be conducted in the county where our principal place of business is located, unless otherwise mutually agreed upon.

Class Action Waiver: To the extent permitted by law, you agree to waive any right to participate in a class action or class-wide arbitration.

12. Data Verification, Privacy, and Security

12.1 Government-Issued Identification and Medicinal Documentation

To comply with applicable laws, especially regarding the purchase of cannabis-related products, all users, regardless of age, must undergo identity verification. In addition:

Standard Users (21+): Must provide government-issued identification for age and identity verification.

Users Aged 18–21: Must provide government-issued identification and a valid medicinal cannabis recommendation from a licensed physician. This documentation will be securely scanned and retained solely for verification purposes as required by applicable law.

12.2 Data Usage and Retention

The data collected for verification—including name, address, identification number, photograph, medicinal documentation, and other relevant information—will be stored securely and used only for purposes such as enforcing purchasing limits, simplifying future identity verifications, and optimizing our services.

We retain and process such data in accordance with our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy for additional details.

13. Modifications to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide you with at least 30 days' notice before the changes take effect. You are responsible for reviewing these Terms periodically. Your continued use of the Service after the changes become effective constitutes your acceptance of the new Terms. If you do not agree to the new terms, you must stop using the Service.

14. Miscellaneous Provisions

Entire Agreement: These Terms constitute the entire agreement between you and Culture Cannabis Club regarding your use of the Service and supersede all prior or contemporaneous understandings or agreements.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms without our prior written consent. We reserve the right to assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.
